V COMPLAINTS AND RETURNS
5.1. Consumers and eligible individual business buyers defined in section 5.7 have statutory rights where goods do not conform to the contract. The seller is responsible for nonconformity existing upon delivery and becoming apparent within two years of delivery, unless a longer stated useful life applies. There is no requirement to notify us within two months of discovering the problem. Mandatory statutory rights are not limited by these terms.
5.2. Send complaints to biuro@lefantome.eu or by post to the Store address in section I. Describe the problem and the remedy requested. An order number or other evidence of purchase helps identify the transaction; a specific receipt or invoice is not a mandatory attachment or the only acceptable evidence.
5.3. We answer consumer complaints on a durable medium, such as email, within 14 days of receipt. If we fail to reply within that period, the consumer complaint is deemed accepted. We also undertake to reply to eligible individual business buyers within 14 days; this does not extend the statutory deemed-acceptance rule of Article 7a of the Polish Consumer Rights Act to such buyers. The response deadline is separate from the time required for repair or replacement.
5.4. You may first request repair or replacement, free of charge, within a reasonable time and without excessive inconvenience. Subject to the statutory conditions, you may request a price reduction or terminate the contract, including where repair or replacement is refused or not performed, nonconformity remains despite an attempt to remedy it, or is sufficiently serious to justify an immediate remedy. Termination is unavailable for minor nonconformity; nonconformity is presumed serious. The detailed rules are in Articles 43d–43e of the Polish Consumer Rights Act.
5.5. If goods are needed for repair or replacement, we will arrange access and collect them at our expense. The Store bears repair and replacement costs, including transport, labour and materials. On termination for nonconformity, the affected goods are returned at our expense. Other, conforming products in the order need not be returned.
5.6. Consumers and eligible individual business buyers may withdraw from a distance purchase without giving a reason within 14 days of receiving the goods themselves or through a designated person other than the carrier. For goods from one order delivered separately, the period starts when the last item is received; for goods delivered in parts, when the last part is received. Send an unequivocal notice before the period expires, for example to biuro@lefantome.eu or by post to LE FANTOME Michał Pasella, Nad Stawem 24/9, 44-151 Gliwice, Poland. No specific form, signed scan or reason is required. Send the goods back within a further 14 days of notifying us; timely dispatch is sufficient.
5.7. An eligible individual business buyer is a natural person entering into a contract directly related to their business activity where the contract is not professional in nature for that person, assessed in particular by reference to their business scope recorded in CEIDG. Such buyers benefit from the withdrawal and nonconformity rights in sections 5.1–5.6 and 5.8 under Chapters 4 and 5a of the Polish Consumer Rights Act. Purchase is not conditional on submitting a declaration of this status. Other business buyers retain the rights applicable to their contracts; these consumer protections do not automatically apply to every business purchase.
5.8. For withdrawal without giving a reason, we refund payments without undue delay and no later than 14 days after receiving your withdrawal notice. For withdrawal from the whole contract, this includes the cost of the cheapest standard delivery offered, but not any supplement for a more expensive delivery option. Unless we offered to collect the goods, we may withhold the refund until we receive the goods or evidence of dispatch, whichever is earlier. We use the original payment method unless you expressly agree to another method without refund costs to you. Subject to the statutory conditions, you are responsible only for diminished value caused by handling beyond what is needed to check the nature, characteristics and functioning of the goods. Signs of use do not automatically remove your withdrawal right. Free return dispatch through our designated parcel-locker service is available within Poland; for another dispatch method or returns from abroad, you bear the direct return costs. See Return and exchange.
5.9. Please do not send returns cash on delivery. This practical shipping instruction does not limit statutory rights.
5.10. A commercial guarantee is an additional right only if granted for the particular product. Its scope, duration and procedure are defined in the guarantor’s statement or document. It does not limit statutory nonconformity rights against the seller.
VI. RETURNS OF RECEIVABLES
6.1. Refunds for withdrawal and complaints follow section V. For a statutory price reduction, we refund the appropriate amount within 14 days of receiving your statement. For termination due to nonconformity, we refund the price within 14 days of receiving the affected goods or evidence of dispatch. For cancellation of a prepaid order or part before fulfilment, we refund the relevant amount within 14 days of cancellation.
6.2. We use the original payment method for refunds. Another method requires your express agreement and must not result in refund costs to you. In particular, card refunds are made to the payment instrument used; we do not require a bank account number or card details by email.
